The Debate Is Over: Indiana Judge Rules that Tacos & Burritos are Sandwiches

Since time immemorial, there have been debates about just what foods count as a sandwich. Well, humanity is closer to getting an official answer after a judge in Fort Wayne, Indiana, has ruled that burritos and tacos count as sandwiches.

As reported by WishTV.com, the decision came during a dispute after commercial developer and restaurant owner Martin Quintana sought zoning changes for a strip mall. Agreeing to commitments proposed by neighbors to keep fast food chains (McDonalds’, Arby’s’, Wendy’s’, Burger King, etc) out, Quintana made plans to expand a restaurant called The Famous Taco Mexican Grill into the area, special accommodations were added that would allow for establishments like Subway or Jimmy John’s’ where customers get made-to-order sandwiches, counting The Famous Taco Mexican Grill’s menu items of tacos and burritos as “Mexican style sandwiches.”

And while the neighbors agreed, the Plan Commission didn’t, with Quintana deciding to get a judge to review the matter. And so on May 14 of this year, Allen Superior Judge Craig J. Bobay did, ruling that:

“The proposed Famous Taco restaurant falls within the scope of the general use approved in the original Written Commitment. The proposed Famous Taco restaurant would serve made-to-order tacos, burritos, and other Mexican-style food, and would not have outdoor seating, drive through service, or serve alcohol. The Court agrees with Quintana that tacos and burritos are Mexican style sandwiches, and the original Written Commitment does not restrict potential restaurants to only American cuisine-style sandwiches.”
